GEMA isn't really equivalent to the RIAA. They don't represent labels, but rather serve as a royalty collecting agency for German artists. The current scenario is actually somewhat worse than you've described. GEMA is attempting to collect for artists even if they're not GEMA members. I'm a member of ASCAP (one of the US royalty agencies) and GEMA is now trying to collect royalties on my Thinner downloads.
