I've not heard the track, but it's a very common practice for
artists to build a track around a sample, but when it turns out
to be un-clearable or too expensive, they just re-record the loop.

Somewhere at home I have a DAT bootlegged from a Seattle studio that's
chock full of loops that were recorded from scratch, and then treated
so that they sound as though they were nicked from old records.  The
story that came with the tape was that a record label, having been
burned by sample clearance, commissioned the loops as legally un-entabled
fodder for their producers.
