For authors, it's lifespan plus a large chunk of years (50? 95?).  I
assume it's similar for music (different time limits for compositions and
recordings perhaps?).  The basic thing about copyright is that if you fail
to defend it, you lose it. Once people started using Amen and not getting
sued, it became fair game for everyone else.  And re: sample CDs, you can
almost be sure they're sampling sources which don't have the resources to
retain a lawyer that long after they made their music.
